VOICE-2-TEXT ACADEMY
POLICY, PROCEDURES, CONTRACT.
This BUSINESS AGREEMENT (“Agreement”) is entered into as of the date enrolled to the Voice-2-Text Thinkific course of the Student and Julia Emerson of Voice-2-Text Academy (“Instructor”.)
SERVICES DEFINED:
Instructor agrees to provide pre-recorded training in voice writing dictation techniques, Dragon Naturally Speaking training, speed building techniques, and to assist in certification skills testing and certification written testing to the Student.
Instructor agrees to provide pre-recorded career training in either court reporting or caption provider careers to the Student. The Instructor will provide basic pre-recorded career training in the career path the Student has selected to ensure that the Student is capable of performing basic duties in their selected career.
The Instructor will deliver the following educational pre-recorded course in the following capacity:
- Provide pre-recorded lessons,
- Satisfy the learning objectives set forth in the syllabus and/or Course as outlined in the course material to assist the Student in obtaining a passing grade;
- Administer to the Student appropriate quizzes and skills tests during the Course to assist the
Instructor and the Student in evaluating the Student’s progress and;
- Communicate with the Student via email, [email protected] (or similar), in a timely manner (Usually within 48 hours.)
The self-paced Course is not a lifetime course. The Student will have access to the course one (1) month after the Student has completed and satisfied the last week’s module. Extensions are not guaranteed and must be approved.
STUDENT AGREES TO:
- Student will make himself/herself/themself available on a reasonable basis to engage in the pre-recorded class, commit to a minimum of two (2) hours a day, four (4) days a week practicing skills taught in the course, and to complete any and all assignments, quizzes, and tests in a timely manner.
- Student is solely responsible for and agrees to communicate with the Instructor via email, [email protected] with questions and to notify the Instructor if the Student is struggling with any topic or skill.
- Student agrees their efforts and results are their responsibility and include, but are not limited to, attendance, advancing through the course, advancing through speed building, studying for quizzes, all of their practice time, studying for the written exam, passing their certification tests, and all other work related to this course and related to passing dictation and written tests to get certified, if they so choose to do, and any other efforts not listed herein.
PAYMENT TERMS AND CONDITIONS:
The Student shall pay the Instructor in full to access the self-paced course. The total cost of the course is listed on the Thinkific website. There is a $200.00 non-refundable fee if student withdraws under the withdraw guidelines.
REFUNDS:
An eligible refund is when the Student emails the Instructor at [email protected] stating they are withdrawing from the course within a two-week period of the date of signing up to the Thinkific course. This will qualify the Student for a full refund, minus the non-refundable fee/deposit, totaling $1,300.00.
No refunds will be given after the two-week window of the first day of signing up for the Thinific Course.
Withdraw, for purposes of this contract, means dropping out of the course before the end of completing all of the coursework. It is preferable that the Student send notice in writing via email; however, it is not required to withdraw. Student is considered withdrawn after three (3) weeks or more of nonparticipation.
Nonparticipation is when the Student does not access the course, do any assignments, homework, quizzes, watch pre-recorded video lessons, or work on any other material in three (3) consecutive weeks, and/or communicate via email with Instructor of personal issues.
Actions of withdraw are, but not limited to; a) not working on the coursework in the modules; b) notifying the Instructor via email that the Student is no longer continuing with the course; c) non communication with Instructor; d) any other action showing no interest.
METHOD OF INSTRUCTION:

NON-DISCLOSURE:
Voice-2Text Academy course materials are protected. The Student will not distribute or share the Course material in any way to any other person via email, text, FB messenger, any other social media messenger or text method, or any other communication over the Internet, or to copy and print any materials or distribute printed materials via email, or in person, or any other way of distribution.
The Student agrees not to disclose, copy, clone, modify, download, or upload via the Internet, email or any other electronic means not agreed to by the parties, any information related to this training and/or mentoring.
“Confidential information” refers to any data and/or information that is related to the Student in any form, including, but not limited to, oral, written or shared during a virtual platform, such as Zoom, such as discoveries, processes, techniques, programs, knowledge bases, customer lists, viewed content on Instructor’s shared view, potential customers, business partners, affiliated partners, leads, knowhow, or any other services related to the training and/or mentoring of the Student.
REFERENCE MATERIAL(S) AND SUPPLIES:
Students agree to supply their own reference and study materials, grammar and punctuation materials, certification practice, speed building practice material, and study materials and/or guides, etc. for the Course at their own expense.
Students agree to supply their own laptop, software, and hardware they believe they need, or from the suggested list previously provided to the Student, to complete this Course and are responsible for any extra costs that may incur for hardware or software.
WARRANTIES:
Instructor represents that Instructor's lectures shall contain nothing of such a nature that could be reasonably considered scandalous, defamatory, or obscene. Instructor further represents that any and all educational materials utilized in the Course shall not violate, infringe, or impede the legal or equitable rights of any person, firm, corporation, or other organization.
TAX DUTIES AND RESPONSIBILITIES:
Neither federal, nor state, nor local income tax nor payroll tax of any kind shall be withheld or paid by the Student on behalf of Instructor or Voice-2-Text Academy. The person provided by the Instructor to perform services hereunder shall not be treated as an employee with respect to the services performed hereunder for federal or state tax purposes. Instructor understands that it is responsible to pay, according to law, all applicable taxes, if any. Taxes are included in the cost of the course.
TERMINATION WITH CAUSE:
With reasonable cause, either party may terminate this Agreement effective immediately upon the giving of written notice within fourteen (14) days of termination with cause.
Reasonable cause shall include, without limitation:
- material violation of this Agreement;
- any act exposing the other party to liability to others for personal injury or property damage;
- cancellation of the subject event;
- any circumstance beyond the control of either party, including not wanting to pursue a voice writing career. (Reasonable cause on the part of the Instructor does not include a low number of fully paid registrants resulting in a commensurate reduction in Teaching Fees.)
NOTICES:
Any notice given in connection with this Agreement shall be in writing, and shall be delivered in writing to the party at the party's email address stated herein. Any party may change its email address stated herein by giving notice of the change in accordance with this paragraph.
CHOICE OF LAW:
Any dispute under this Agreement or related to this Agreement shall be decided in accordance with the law of the State of South Carolina.
ARBITRATION:
Any dispute under this Agreement or related to this Agreement shall be submitted to binding arbitration by the American Arbitration Association. Damages shall be for actual damages only; punitive damages shall not be awarded.
PREVIOUS AGREEMENTS
This Agreement cancels and supersedes all previous agreements by and between Instructor and Student and constitutes the entire agreement between the parties hereto.
AMENDMENT
This Agreement may be amended or modified only by written agreement executed by both of the parties hereto.
